Terms & Conditions

  1. Your Body Matters provides clients (hereinafter referred to as “members”) with the use of their gymnasium, equipment and advice for the purposes of improving members fitness and physical condition. It is entirely the responsibility of each member to use Your Body Matters equipment regularly, to follow the advice provided by Your Body Matters personnel, and to make the lifestyle changes necessary to maximise their benefits. No guarantees relating to individual members results are made or implied by Your Body Matters.
  2. Membership is valid at the Your Body Matters premises from the date stated on the Enrolment Form.
  3. Membership paid for by Direct Debit is through an Agreement with Debit Finance Collections. This agreement will clearly state the minimum period of membership and all payments must be made within the agreed period.
  4. After completion of your agreed membership period, should you wish to cancel you must do this in writing giving one months notice. Membership will end one month after the date the letter is received by us.
  5. All membership fees are payable for the full term of your agreement, regardless of your attending the gym. No refunds or time will be retuned for none attendance (please see point 27).
  6. Your Body Matters will use its best endeavours to ensure that all equipment and facilities are maintained in full working order, but cannot be held responsible for the unavailability of equipment when breakdowns occur. Your Body Matters will make every effort to ensure speedy repair and return to use.
  7. Members use Your Body Matters equipment, facilities and services at their own risk. In the unlikely event of injury or incapacity during members’ use of the equipment, facilities or services, Your Body Matters cannot be held responsible except when it can be shown that they were negligent.
  8. Members are advised NOT to bring valuables onto the premises but when they do so, are requested to use the lockers which are provided for member’s use whilst on the premises. Your Body Matters cannot be held responsible for loss or damage to member’s property.
  9. Your Body Matters does everything within its power to ensure the health and safety of its members and personnel. It is the duty of members to use the equipment and facilities responsibly and to take all possible steps to minimise the risk of injury to themselves and to others by immediately reporting to the management any accidents, hazards, breakages, or anything else which they consider might constitute a risk to health and safety. In the event of a fire, members must raise the alarm and exit in accordance with the Fire Evacuation Policy displayed in the premises.
  10. Members may not use any equipment or facilities without the express permission and supervision of Your Body Matters personnel. The said equipment and facilities may only be used in the manner prescribed by the said authorised personnel. Members will refrain from use of Your Body Matters equipment, facilities or services when expressly advised to do so by their doctor or medical consultant.
  11. Members agree to do everything possible to minimise their risk of injury or incapacity by a) declaring their medical history/condition in full on commencement, and b) by following the exercise programme prescribed by Your Body Matters personnel.
  12. Members will report to Your Body Matters any change in their medical condition, or any variation in the advice they receive from their doctor or medical consultant.
  13. Should a member pass away with a valid membership, Your Body Matters will allow the remaining membership to be transferred to family member or friend, but is unable to offer any refund.
  14. Members agree to wear appropriate clothing and footwear at all times when using Your Body Matters equipment and facilities. Smart, clean loose clothing, i.e. trousers, tracksuit or shorts and top, plus flat shoes, trainers, are considered appropriate. Jeans, skirts, dresses and outdoor shoes are NOT permitted.
  15. Your Body Matters reserve the right to refuse admission to a member when they consider this to be appropriate and shall not be obliged to give a reason. They shall be entitled to eject and/or suspend a member if, in their opinion that member’s conduct is such that it may bring the facility into disrepute, or interfere with the well being and quiet enjoyment of other Members, or if it amounts to breaking the rules and conditions of use, or constitutes unreasonable behaviour. In these circumstances, Your Body Matters will be under no liability to refund fees or otherwise.
  16. Your Body Matters and its personnel are committed to treating members with friendship and courtesy at all times. Members are required to treat other members and guests, and Your Body Matters personnel, in the same manner.
  17. No one is permitted to enter or use Your Body Matters facilities while under the influence of alcohol, and bad language or rude or threatening behaviour will result in eviction and possible suspension.
  18. Your Body Matters hours and days of opening are set by the management who reserve the right to alter these if considered necessary.
  19. For sessions that are booked by prior appointment, members are expected to inform Your Body Matters by telephone if unable to attend, giving as much notice as possible.
  20. Members are expected to be punctual for their appointments to avoid inconveniencing other members. Punctuality involves being ready to commence exercise at the designated appointment time. In the event of a member arriving late for an appointment she must be prepared to miss her session altogether or miss one or more exercise stations at the start of her circuit. Members arriving early are not permitted to commence their exercise circuit until their allotted appointment time unless no other member is ready to commence.
  21. Members who pre-book sessions should always print both their name and membership number in a designated time slot on the Appointment Sheet at reception. Appointments may also be made and cancelled, via the telephone. Appointments may not be recorded for more than one week ahead. Members are advised not to book sessions on consecutive days. On arrival for each session, members must record their attendance by ticking the Appointment Sheet in the appropriate column; they must also remove their Programme Card from the file and take this around the exercise circuit with them. On completion of each session, the Members should replace their Programme Card into the correct place (numerical order) within the file.
  22. A session is considered to be one complete circuit of the exercise stations. Each session takes 30 minutes to complete and it is not permissible to extend this time period as this would delay other members following on behind. Members must observe the traffic light system when exercising and change stations whenever the display changes from green to red. On completion of the circuit, members may not commence a second circuit. For most members, one half hour circuit per session is sufficient to achieve results.
  23. Members who have been given a 60 minute Double Impact Circuit must pre-book 2 time slots in the Appointment Sheet.
  24. The gym will be closed over the Christmas period. There may also be other closures during the year for essential maintenance and staff training. Membership time will not be returned for any of these closures and you will be given advance notice where possible. Your Body Matters will endeavour to keep these closures to a minimum.
  25. Should Act of God, extreme weather conditions, force majeure or other disaster conditions occur beyond the reasonable control of Your Body Matters which forces the gym to close, then the company will not return any membership time.
  26. Members may not sell, or propose the sale of goods or services, nor organise collections or petitions within Your Body Matters premises, without the consent, in writing, of a Your Body Matters Director.
  27. Members agree to make payment of membership and enrolment fees as agreed at the time of enrolment. In the event of non payment, Your Body Matters reserves the right to withdraw their services and facilities until payment is made.
  28. Following enrolment, all fees are due on the dates agreed, regardless of the member’s attendance or non attendance, except when special circumstances exist as outlined below. In the unlikely event that a member is suspended for contravention of the Terms and Conditions of Use, including non payment of fees, any outstanding fees are still due and payable on the dates agreed at the time of enrolment.
  29. There is a No Refunds policy covering all advance membership fees, paid upfront or direct debit payments. In the case of long term medical incapacity which must be confirmed in writing by the member’s doctor or medical consultant and must clearly state “that the member is unable to perform light exercise for a period of not less than six months” After the six months has passed a further confirmation will be required from the members doctor to confirm the member is still unable to participate in light exercise, a refund may be considered by the management in this event on a case by case basis. If this is agreed, a maximum refund of six months membership fees will be granted only (excluding any upfront payments).
  30. In the event of a member becoming pregnant, we advise that a member continues to exercise for as long into the pregnancy as possible, proving there are no other health complications. Membership can be suspended and resumed following the birth. The suspension can remain in place up to twelve weeks following the birth, except where a Doctor advises a longer period of recovery. Members should remember not to cancel any direct debits within your initial agreement; additional membership will be added on immediately after the initial agreed period is complete. Your Body Matters personnel will be more than happy to amend a Member’s programme following giving birth to ensure a safe return to exercise.
  31. Your Body Matters may agree to transfer any unused portion of a membership to a person of the member’s choice. Such decisions will be at Your Body Matters discretion and only in instances when the membership fee is paid in accordance with the method agreed. In the event of a transfer being authorised, the company will levy a £25 administration charge.
  32. Requests to freeze membership time may be granted when a member is unable to attend for a period of not less than four weeks to a maximum of 12 weeks due to short illness or operation, holiday, business trip, or similar. The member must apply for the suspension prior to the absence. When a fully paid membership is frozen, the time lost is added to the end of the membership. If in the event of a member not returning after a suspended period, the extra time will be added, the membership will expire after the new date has passed. When a membership which is paid by direct debit is frozen, payments must be maintained within the agreed period. The frozen period will then paid back by suspending payments for the frozen period and then the membership payments will then recommence. There will be no loss in Membership while payments are not being collected.
  33. Memberships are usually for a twelve month period, unless otherwise arranged at the time of enrolment
  34. Following enrolment, Your Body Matters may from time to time provide information on further products and services. Should you not wish to receive these please write to the Directors at Your Body Matters, who will remove your details from the mailing list.
  35. Members agree to be bound by these Terms and Conditions of Use which may be altered or added to from time to time at the management’s discretion. Non members and Guests who use Your Body Matters facilities agree to be bound by these Terms and Conditions of Use.
